Terms of Service

Terms and Conditions

1. Scope

These terms apply to all orders placed by consumers and businesses via the online shop Aura of Monaco, operated by [COMPANY NAME / FIRST NAME LAST NAME], [STREET AND HOUSE NUMBER], [POSTCODE CITY], Germany (“we”). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Conclusion of contract

The presentation of products in our shop is not a legally binding offer but an invitation to order. By clicking the “Pay now” / order button you submit a binding order for the items in your cart. We confirm receipt of your order by email immediately. The contract is concluded when we accept your order by a separate email or by shipping the goods. The contract language is English. We store the contract text and send you the order details by email.

3. Prices and shipping costs

All prices include statutory VAT. Shipping costs are shown separately at checkout. For deliveries outside the EU, customs duties and import taxes may apply and are payable by the customer.

4. Payment

The payment methods available are shown at checkout. Payment is due immediately when the order is placed.

5. Delivery

All items are made to order. Production usually takes 2–5 business days, followed by shipping. Estimated delivery times are shown in our Shipping & Returns information.

6. Retention of title

The goods remain our property until full payment has been made.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our Right of Withdrawal.

8. Warranty

The statutory warranty rights apply. If an item arrives damaged or with a production fault, please contact us at [SUPPORT EMAIL]. Because every piece is embroidered individually, minor variations in colour shade and stitch placement compared to product photos are possible and do not constitute a defect.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

10. Dispute resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.
